Professional Disclosure & Participation Agreement
Version 1.2 · Effective October 8, 2026
You are an independent practitioner. You pay a flat subscription for a listing — never a fee per patient. You must be licensed and insured, offer a genuine reduced rate, and follow your College’s rules.
AffordableHealth.ca ("the Platform") is operated by Homula Inc. ("we", "us"). This agreement is between you and Homula Inc.
1. Independent practice
You participate on AffordableHealth.ca ("the Platform") as an independent practitioner. Nothing in this agreement creates an employment, partnership, agency, or joint-venture relationship. You alone are responsible for your clinical services, professional judgment, records, scheduling, billing, taxes (including GST/HST where applicable), and compliance with your regulatory College and applicable law.
2. Eligibility and verification
To be listed you must, and must continue to:
- Be registered and in good standing with the relevant Ontario regulatory College for each sector you list (or, for a sector that is not regulated in Ontario, hold membership in a recognized professional association acceptable to us);
- Hold current professional liability insurance appropriate to your practice;
- Provide accurate registration details and upload government photo ID, proof of registration, and your insurance certificate for verification;
- Promptly notify us of any change to your registration status, any practice restriction, condition, undertaking, caution, or any finding, charge, or proceeding relevant to your fitness to practise.
We verify your registration against the College’s public register before your profile goes live and re-verify periodically. We may suspend or remove your listing at any time if you no longer meet these requirements or if verification cannot be completed.
3. The reduced-fee commitment
- You set your own sliding-scale range for each sector. You commit to offering patients matched through the Platform a genuine reduced fee — meaningfully below your usual private rate — within the range you publish.
- You will not charge a matched patient more than the fee you and the patient confirm in the Platform for a given appointment.
- Fees for care are collected by you, directly from the patient. The Platform does not process payment for care and takes no share of your fees.
4. Subscription — how we are paid
- You pay a flat periodic subscription for your listing. The subscription is for advertising and access to the Platform. It does not vary with the number of patients you see, requests you receive, or appointments you book, and there is no per-lead or per-booking charge and no commission.
- This structure is deliberate: paying or receiving a fee tied to patient referrals may breach College rules on referral fees and fee-splitting. You must not enter into any side arrangement that would make a payment to or from us contingent on patient volume.
- A subscription starts when you choose a plan. Some promotion codes include a free period, and the first charge is then taken when it ends. The subscription renews automatically until cancelled. You can cancel any time, effective at the end of the current period. Fees already paid are non-refundable except where required by law.
- If payment fails or an invoice is unpaid past its due window, we may suspend your listing until it is resolved.
5. Advertising and profile content
Your profile, headline, biography, and any claims you make remain subject to your College’s advertising standards and the law. You are responsible for ensuring your profile is accurate, not misleading, and compliant. Do not imply a guarantee of results. We may edit or remove non-compliant content.
6. Patient interactions and safety
- Screen for urgency. The Platform is not for emergencies; if a patient contact suggests an emergency or crisis, direct them to 911 or 988 and do not rely on the Platform for time-critical care.
- Respond to requests promptly, or decline them. Do not accept requests outside your competence, scope of practice, or the sectors you are verified for.
- Keep communication inside the Platform until an appointment is confirmed. Maintain your own clinical records — the Platform is not your record-keeping system.
- Obtain your own informed consent and comply with PHIPA as the health information custodian for the care you provide.
7. "Available now"
If you go online for "Available now", you may receive real-time requests from patients in your sectors. Going online is optional and you control it. Offering to help is at your discretion. You remain responsible for assessing suitability and urgency before agreeing to speak with or see anyone.
8. Data and confidentiality
You will use patient information received through the Platform only to respond to that patient’s request and provide care, in accordance with PHIPA and your College’s rules. You will not use it for marketing or disclose it improperly. Our handling of your information is described in the Privacy Policy.
9. Suspension and termination
You may leave at any time by cancelling your subscription and asking us to remove your profile. We may suspend or terminate your participation immediately if you breach this agreement, lose your registration or insurance, or if we reasonably believe patient safety or the integrity of the Platform is at risk.
10. Indemnity and liability
You indemnify AffordableHealth.ca against claims arising from your services, your conduct, your profile content, or your breach of this agreement. To the fullest extent permitted by law, the Platform is not liable to you for lost patients, lost revenue, or indirect losses. The Platform is provided "as is".
11. Changes
We may update this agreement. Material changes will be notified and you will be asked to accept the new version to continue. The current version is at /legal/professional_agreement.
By submitting your application you confirm that you have read, understood, and agree to this Professional Disclosure & Participation Agreement, that you are licensed and insured as described, and that all information you provide is true.
